    Program: Union representation may be at an all-time low, representing less than 7 percent of the private sector workforce. There are many reasons for the decline in union support.     However, complacency is the union organizer’s best friend. Certain industries and regions are at much higher risk.

    In addition, organized labor has found a formidable ally in the NLRB with its rulings on many issues from  micro-units to off-duty access rules to who is a supervisor.  Indeed, one could wonder whether the “R” stands for “relations” or “recruitment.”

    This seminar will provide: (a) an overview of the current election process; (b) recent cases on what is an appropriate bargaining unit; (c) who your statutory supervisors are (whom you can control); (d) key elements of supervisory training; (e) elements of an early detection and rapid response plan; (f) whether and how to educate your employees proactively; (g) union inhibitors, such as solicitation and distribution and off-duty employee policies; (h) social media and union organizing and (i) common employee relations drivers for union organizing.

    To remain union-free, we need to prove to our employees, by our words and actions, that whatever problems may exist can be addressed more effectively without the intervention of, but what is in fact, another regulator.

    And, we need to be careful not to suggest that we are "anti-union." Too many of our employees have union roots. I do, too. The key is to focus on how a union could make it harder for all of us to achieve the organization’s mission.

    Speaker: Jonathan A. Segal is a partner at Duane Morris LLP in the Employment, Labor, Benefits and Immigration Practice Group. He is also the managing principal of the Duane Morris Institute.
